Condominium Insurance Alert
The condominium Act 1998 (the "Act) states that the corporation is obligated
to obtain insurance against major perils on the common elements and the
standard unit. this obligation to insure does not include insurance for damage
to improvements made to a unit. The question of what constitutes an
improvement, or betterment to a unit, is determined by reference to "the
standard unit" as described in a by-law duly passed for such purpose. It
follows that the onus to insure the contents and any and all betterments to a
standard unit rests on the unit owner...

Mortgages and Justice (Globe & Mail article Feb 8, 2007)
It takes a big person to admit he's wrong. Thankfully there were enough big
people on the Ontario Court of Appeal to admit the court was "incorrect" when
it held an innocent homeowner responsible for paying for a mortgage registered
fraudulently in the homeowner's name...
